Legal Jurisdiction in Electoral Appeals for Yemen House of Representatives Nominations

This study aims to determine the competent judicial authority for deciding electoral appeals related to nomination disputes for legislative elections in Yemen. The focus is on validating the data and conditions required for a candidate, whether the jurisdiction lies with ordinary, administrative, or constitutional courts, and sometimes the legislative council. The study examines the scope and limits of judicial oversight on nomination disputes, whether this oversight is limited to administrative decisions issued by committees or competent authorities receiving and deciding on nominations or includes decisions to accept nominations. It also clarifies the boundaries of judicial oversight over administrative decisions, through the permissibility or prohibition of judicial appeals before the Supreme Judicial Authority. This study is the first of its kind to highlight the Yemeni judiciary's control over electoral appeals related to nomination disputes for membership in the Yemeni House of Representatives.
