The general procedural system and its impact on the implementation of foreign judgments in Yemen

The increase in the volume of trade exchanges between countries due to heightened movement of people and goods across national borders has fostered private transactions and relationships. To address the challenges posed by these interactions and ensure effective implementation of foreign judicial rulings, national legislation and laws establish conditions and controls for executing foreign judgments. These conditions strike a balance between enforcing foreign judgments and safeguarding fundamental principles and values within the country. Notably, some national laws and international agreements present obstacles or cases of refusal to implement foreign judgments. In all instances, a foreign judgment—whether judicial or arbitral—cannot be enforced outside the issuing state’s territory without the intervention of the judicial authority in the implementing state. This intervention respects the principle of the state’s independence and sovereignty. Upon request, the implementing state’s courts order the execution of the foreign judgment after verifying compliance with all conditions stipulated by national law.
